1. General Brokerage Conditions for Third-Party Services

1.1 Conclusion of Contract


By submitting a booking request (in writing, by phone, online, or in person) and its acceptance by Orbis Aureus AG, a contract is concluded between you and Orbis Aureus AG. This agreement establishes mutual rights and obligations.

We strongly recommend that you carefully read these General Terms and Conditions as well as the details of the travel offer, as they form an integral part of the contract.

If you register additional travelers, you are responsible for their contractual obligations (in particular payment) as for your own.


1.2 Third-Party Services

If Orbis Aureus AG acts as an intermediary for travel arrangements provided by third parties, the terms and conditions of those providers apply.

For flight tickets, the conditions of the respective airline apply. In such cases, Orbis Aureus AG is not a contractual party.

The contract with the airline is only concluded upon ticket issuance. Changes made by the airline prior to ticket issuance are at your expense.
 

1.3 Scope of Services

Our services begin at the published departure airport (Switzerland or EU) or at the destination, depending on the offer.

It is your responsibility to arrive on time at the departure point.

Any special requests are only binding if confirmed by us in writing.
 

2. Booking

We recommend booking as early as possible. Provisional reservations may be made without obligation until a specified deadline.

Flight bookings are excluded from this and usually require immediate ticket issuance.
 

3. Prices and Payment Terms
 

3.1 Prices
 

Prices are based on the current offer or individual quotation.

Unless otherwise stated:

  • Prices are per person

  • Quoted in CHF or EUR

  • Based on double occupancy

  • Inclusive of VAT
     

3.2 Fees

  • Visa processing fee: minimum CHF 60 per person

  • Additional service or handling fees may apply
     

3.3 Payment Terms
 

Deposit:
30% of the total price or minimum CHF 700 per person upon booking

Balance:
Due 45 days prior to departure

For bookings made within 45 days, full payment is required immediately.

Failure to pay on time entitles us to refuse services.
 

3.4 Price Adjustments

We reserve the right to adjust prices due to:

  • Fuel surcharges

  • Government taxes or fees

  • Currency fluctuations

  • VAT changes
     

If the increase exceeds 8%, you may cancel free of charge within 5 days.
 

4. Cancellation and Changes
 

4.1 Handling Fees

Before cancellation deadlines:

  • CHF 100–200 per person
     

4.2 Cancellation Fees

For packages and land arrangements:

  • Up to 45 days: 30%

  • 22 days: 40%

  • 15 days: 50%

  • 8 days: 60%

  • 4 days: 80%

  • 3 days or no-show: 100%
     

Special stricter terms may apply (e.g. yachts, lodges, peak season).

Flights follow airline policies.
 

4.3 Substitute Travelers

You may transfer your booking to another person if:

  • All conditions are met

  • Suppliers accept the change

  • Legal requirements are fulfilled
     

Both parties remain jointly liable.
 

5. Liability
 

5.1 General

We ensure:

  • Careful selection of partners

  • Accurate service descriptions

  • Professional organization
     

5.2 Limitation of Liability

Liability is limited to twice the travel price and only covers direct damages.

No liability for:

  • Delays

  • Strikes

  • Force majeure

  • Third-party failures
     

5.3 Local Services

Excursions booked locally are provided by independent companies.
We assume no liability for these services.

 

5.4 Injury, Illness, Death

Liability applies only in cases of proven fault and is subject to international conventions.
 

5.5 Property Damage

Compensation applies only in cases of fault and is limited.

We recommend travel insurance.
 

5.6 Financial Protection

We participate in the Swiss Travel Guarantee Fund, ensuring your payments are protected.
 

6. Complaints

Complaints must be reported immediately on-site.

Claims must be submitted in writing within 4 weeks after return.

Failure to comply voids claims.
 

7. Program Changes

We reserve the right to modify services due to unforeseen circumstances.

If changes result in reduced value, compensation may be provided.
 

8. Cancellation by Orbis Aureus AG

Trips may be canceled due to:

  • Force majeure

  • Safety concerns

  • Insufficient participants
     

Full refund will be provided. No further claims apply.
 

9. Early Termination by Client

No refund for unused services.

We recommend travel interruption insurance.
 

10. Passports, Visas, Health Requirements

You are responsible for all travel documents.

We assume no liability for denied entry.
 

11. Flights

Flights are subject to change.

Economy class applies unless otherwise stated.
 

12. Activities

Availability of sports and activities cannot be guaranteed.
 

13. Governing Law

Swiss law applies.

15. Travel Insurance

Insurance is not included.

We strongly recommend:

  • Cancellation insurance

  • Medical insurance

  • Liability insurance
     

Insurance contracts are concluded directly with the insurer.
